I'm sure these police officers have had enough time to change their passwords and telephone numbers since their accounts were hacked into and put on the Net over a week ago. If they haven't they must be pretty damn stupid!

This first post is of some of the police officers we will read about. Some of these police officers talk about sex and others talk about Ni**ers.

Assume for a second that investigators had a legal basis for the seizure of a personal computer and were going to do a forensic examination of the data. If the computer goes directly to the forensic analysts prior to the Property Room and there is no evidence recovered, would the computer still go to Property for release to the owner? I would assume that the actions of an officer who seizes a cell phone, smart phone, etc. would have similar evidentiary, chain-of-custody procedures and requirements. The nexus of this decision to iPads is, in my humble opinion, the next logical step. My old TREO Smart Phone is as much a mini-computer as it is a phone. Given the CA Supreme Court decision (which really surprises me) those iPads will be good targets for investigators.

Below is a link to a Monday CA Supreme Court ruling that police arresting a person can search routinely the entire contents of a cell phone / smart phone / PDA in the property of the arrested person to the same extent that they could search his clothes or a pack of cigarettes in his possession (2 examples given that had previously been ruled as justifiable). This includes searching all of the data on the "smart phone" (data files, address book, links, etc.) as part of the search of the person, with no warrant needed, and no further justification needed than that the search was part of the search of his personal property incident to the arrest. Presumably if something is found, the phone becomes evidence. There was no mention of whether password protecting the phone would have resulted in a different ruling. Part of the dissenting opinion was that this ruling was too broad because it could logically be extended to the contents of a notebook computer in the possession of the arrestee.

Evidence Issue: Documenting chain of custody while the arresting officer / detective / forensic computer person had the phone if the investigation is prior to the time that the phone is booked into the property system. My thought is that that is very likely, because there would no reason to book it in as property unless they had already determined that something beneficial was on it (unless it was to irritate the arrestee).

Colleagues,

Many of you work or have worked in Property and Evidence Rooms. All of us have been with Joe in our IAPE classes when the subject of the destruction of dangerous drugs, i.e. as soon as possible after they are seized, is discussed. The words, "Wouldn't it be nice to be able to take a picture, keep a sample and destroy all of the rest of the drugs thereby not having to hold them until trial?"

I thought that you might find it of interest to see what how the statutes of New York State address the above challenge. As you read through these, I'd ask you to think about a Property Officer or Evidence Custodian who has the responsibility for the destruction of illegal drugs. Who does the research, the documentation, the liaison with other CJ components, etc.?

I've heard of people being ignorant but Police Chief James Harris III of the Los Fresnos Police Department is just plain stupid! This guy had over 50 accounts on his computer ranging from bank accounts to gay porn sites and all his passwords, as well as social security numbers. I will not post the information, but I would suggest to Chief Harris don't use the same password on every account.

Forgive me, but I will have to check with TML before I copy you on correspondence; until they are served, Gamez, Coronado and Harris are not yet parties. Nonethless, I will be happy to send you copies of what I file.

Mr. Winstead is a bit difficult as I'm sure your clients have told you. He original sued only the constable, the City of Los Fresnos and Officer Gamez; Gamez has yet to be served, so far as I know. Winstead then began to write "letters" almost daily to the court, adding new claims and parties. Finally, the court told him to file one amended complaint naming everyone he wanted to sue and why. Well, that opened the flood gates. He fill a 50 page, handwritten complaint that he has has been the victim of persecution since his arrest in 2000. [Do you want a copy?] He has sued the County, Brownsville, Harlingen, Los Fresnos, a cast of police officers and sheriffs deputies, all his defense lawyers in his cases, and the presiding judge in his criminal cases.

If you hear that Gamez, Harris, or Coronado are served, advise ASAP so I can ask TML to take up the defense.

As for the matter in Feb. 2007, Winstead basically alleges Coronado and Gamez arrested him without probable cause and used excessive force (i.e., tasered him a lot). He alleges the Chief was negligent in training and supervising the officers. Note: Winstead plea guilty to the offense of trying to take a taser from an arresting officer. That was his second felony. He is now faced a 3rd felony charge in state court, which the DA is trying to enhance to a life sentence. Not surprisingly, Winstead wants the federal court to vacate his prior convictions.

One issue that has been a road block -- Winstead is in a guardianship for being mentally incompetent but his guardian is not a party. I moved to dismiss on the basis he has no standing to sue apart from his guardian. I gather his guardian, who is his mother, is trying to terminate the guardianship. However, she has yet to properly move to terminate it.

I intend to move to dimiss the state claims against individual officers under TTCA 01.106. The TTCA requires the City file that motion. However, I cann't file a formal Rule 12b motion for them until they are served; they are not parties. I intend to "suggest" a dismissal of all claims against Harris and Coronado because Winstead did not move to add them until after limitations. Yes, I know imcompetency tolls limitations, but Winstead claims he was never incompetent.
