Instead of going to jail for possible DWI, alcohol, and or drugs, the deputy allowed Counsil to be taken home by his daughter.

Around midnight on October 12, 2025, Brenham resident Carey Counsil, a professor at Blinn College, was returning from the Austin County Fair when his vehicle left the roadway near his home.
Council’s vehicle struck a metal gate, continued into an adjacent field, and ultimately came to rest in a pond.
When responding troopers arrived on scene, they located the pond several hundred feet from the roadway with Council’s Jeep partially submerged. Texas Trooper Yoder exited his patrol vehicle and immediately entered the water to find the driver.
Authorities reported that when the Jeep crashed into the pond, the vehicle’s crash-notification system automatically activated. During the emergency call, 9-1-1 communications personnel could hear a voice saying “We’re good” three times, along with audible struggling, movement, and additional indistinct speech in the background.
Local law enforcement, the Department of Public Safety, and EMS deployed drones and conducted an extensive search of the pond and surrounding area in an effort to locate Council.

Around 4:00 a.m., the 9-1-1 Communications Center received a call regarding a break-in at a residence on Old Gay Hill Road.
A woman caller reported that a man was identified as Carey Council, who went into her room and woke her up. The caller stated that Council had left the house and was now sitting on the steps outside the residence.
When deputies arrived and questioned Council about the incident, he initially claimed he had stopped at the Sunoco Gas Station, where he was attacked, thrown into his vehicle, and later woke up in a field.
His account changed multiple times, and he eventually admitted he had lied about being attacked. Council later acknowledged that he had been drinking alcohol at the fair throughout the day.
The Investigation
A DPS Trooper reviewed surveillance video from the Sunoco Gas Station. The video did not show Council stopping at the location. Instead, it showed Council nearly missing his turn onto Gears Road from Highway 36 and making a wide, improper turn.
Council’s daughter later notified the Trooper and reported seeing her father driving his Jeep moments before the crash.
Additionally, Council had posted photographs on his Facebook page and Instagram account during his time at the Austin County Fair, which showed him in possession of BeatBox alcoholic beverages earlier in the day.
Multiple individuals on the scene also referenced these same photos, which were posted on Council’s Facebook and Instagram accounts.
Texas DPS is treating this as a DWI. Either alcohol and/or drugs.
