Around midnight on October 12, 2025, Brenham resident Carey Counsil, a professor at Blinn College, was returning from the Austin County Fair when his vehicle left the roadway near his home.
Counsil’s vehicle struck a metal gate, continued into an adjacent field, and ultimately came to rest in a pond.
When responding troopers arrived on scene, they located the pond several hundred feet from the roadway with Counsil’s Jeep partially submerged. Texas Trooper Yoder exited his patrol vehicle and immediately entered the water to find the driver.
Authorities reported that when the Jeep crashed into the pond, the vehicle’s crash-notification system automatically activated. During the emergency call, 9-1-1 communications personnel could hear a voice saying “We’re good” three times, along with audible struggling, movement, and additional indistinct speech in the background.
Local law enforcement, the Department of Public Safety, and EMS deployed drones and conducted an extensive search of the pond and surrounding area in an effort to locate Counsil.

Around 4:00 a.m., the 9-1-1 Communications Center received a call regarding a break-in at a residence on Old Gay Hill Road.
A woman caller reported that a man, identified as Carey Counsil, entered her room and woke her up. The caller stated that Counsil had left the house and was now sitting on the steps outside the residence.
When deputies arrived and questioned Counsil about the incident, he initially claimed he had stopped at the Sunoco Gas Station, where he was attacked, thrown into his vehicle, and later woke up in a field.
His account changed multiple times, and he eventually admitted he had lied about being attacked. Counsil later acknowledged that he had been drinking alcohol at the fair throughout the day.
The Investigation
A DPS Trooper reviewed surveillance video from the Sunoco Gas Station. The video did not show Counsil stopping at the location. Instead, it showed Counsil nearly missing his turn onto Gears Road from Highway 36 and making a wide, improper turn.
Counsil’s daughter later notified the Trooper and reported seeing her father driving his Jeep moments before the crash.
Additionally, Counsil had posted photographs on his Facebook page and Instagram account during his time at the Austin County Fair, which showed him in possession of BeatBox alcoholic beverages earlier in the day.
Multiple individuals on the scene also referenced these same photos, which were posted on Counsil’s Facebook and Instagram accounts.
Texas DPS is treating this as a DWI. Either alcohol and/or drugs.

The charges stem from an investigation that began after a single-vehicle crash on Oct. 11, 2025, according to DPS Public Information Officer Justin Ruiz.
Ruiz said the crash occurred at about 11:43 p.m. on Pledger Road near Peters Road when Counsil, driving a 2022 Jeep Wrangler, was traveling northbound on Peters Road and failed to stop at the intersection with Pledger Road.
The vehicle left the roadway, struck a barbed-wire fence, entered private property, hit a tree, continued through the property, struck a metal gate and ultimately came to rest in a pond, Ruiz said.
According to DPS, Counsil did not remain at the scene and was located about five hours later and transported to a hospital.
Troopers filed charges of duty on striking a fixture — which applies when a driver damages property and fails to report it — and driving while intoxicated, Ruiz said.

Brenham dispatch records show the initial response was triggered by a crash notification sent from Counsil’s phone. A male voice was heard in the background, and the phone’s location was not moving, prompting a welfare check. Family members later reported receiving a text from Counsil’s phone indicating a crash near Pledger Road and Peters Road, and GPS coordinates were provided to help locate the scene.
Mueller said Counsil has been under DPS investigation since the crash and that troopers obtained warrants for his social media records, tracking data and cellphone data as part of the case. All investigative materials have been forwarded to the Washington County Attorney’s Office.
In addition to teaching at Blinn College, Counsil is a business owner and real estate developer. He previously served on the Brenham School Board, ran for Texas agriculture commissioner and has served as chairman and president of Washington County Crime Stoppers.f
